By submitting your application, you are agreeing to the following terms:
1. Holding Reservation PaymentEach of the proposed tenants is required to pay Posh Pads a holding reservation fee.
The holding reservation payment is not subject to protection under the Tenancy Deposit Protection Scheme in accordance with the provisions of the Housing Act 2004.
2. Tenancy Deposit £195.00 is payable by each tenant this is a full deposit for the Tenancy and is protected in accordance with the Provisons of the Housing Act. Your reservation fee will form part of the total Tenancy Deposit. The total deposit will be held as one tenancy with all tenants being jointly and severally liable.
A bank transfer is preferable for the payment of both your holding reservation fee and tenancy deposit. Transfer your deposit payments or advanced rent payments to the below bank details;

3. Returning the Holding ReservationThe holding deposit will be refunded in full under the following circumstances only:
- Posh Pads withdraws the reserved property and cancels the reservation in writing. OR
- The proposed tenants provided accurate information to Posh Pads, but Posh Pads declines to enter into a Tenancy Agreement prior to the deadline.
4. Retaining the Holding ReservationThe holding deposit will not be refunded under the following circumstances:
- The proposed tenants provide false or misleading information to Posh Pads. OR
- Prior to paying the Initial Holding Reservation payment the proposed tenants have confirmed to Posh Pads that they have sufficient proof to establish permanent or time limited right to rent in England, and subsequent checks reveal this is not the case. OR
- Posh Pads have taken all reasonable steps to enter into a Tenancy Agreement by the deadline for agreement and the Proposed Tenants do not take all reasonable steps to enter into a Tenancy Agreement.
Reasonable Steps Examples of reasonable steps been taken, or parties behaving in a reasonable manner include but are not limited to: providing sufficient information to collect references, contacting all referees in a timely fashion to allow for responses, performing credit checks, attending an appointment to verify the proposed tenant’s right to rent status, providing the security deposit and rent no later than the deadline for agreement.
Payment of Rent All rental payments must be made by Direct Debit. Advanced rent should be paid by bank transfer to the above banking details using the property address as referece.
5. Guarantors A UK based Guarantor is required for all tenancy applications. To be eligible, your guarantor must earn at least 36 times each tenant's monthly rent per annum, be UK based indefinitely, and/or a homeowner. The guarantor form will need to be completed and included with the other documents listed above.
PLEASE NOTE: Your guarantors will be subject to a Credit Check so please ensure they are aware this will be carried out prior to signing for this property.
PLEASE NOTE: Any tenant with no UK based guarantor must commit to a three months advanced rent.
6. Right To Rent In order to comply with the Immigration Act 2014, all tenants and occupiers aged 18 and over must provide proof of right to reside in the United Kingdom.
This proof must be an original document and must be uploaded using Arthur – Posh Pads. Copies for upload are not acceptable. Posh Pads will take and keep copies for up to 12 months after the expiry of your last tenancy agreement.
No tenancy will be completed until the necessary original documentation has been provided by all prospective tenants.
7. Money Laundering All lettings agencies are required to follow procedures to prevent criminals from being able to use our services to launder money, or to finance terrorism in line with the Money Laundering Regulations 2007.
In order to comply we are unable to accept initial holding deposits, full deposits or rental payments in cash or by credit card. You must make any payments to us by bank transfer, direct debit or debit card.
Any refunds due will be paid back by bank transfer to the bank account details provided upon request.
8. Client Money Protection Scheme All letting agents must be part of a client money protection scheme to ensure that all client funds are protected during the running of the business, and to ensure that Landlords or Tenants can raise a claim for compensation should their money be misappropriated.

9. Tenancy Deposit Scheme A tenancy deposit scheme is an independent third-party scheme, approved by the UK government, to hold and protect a tenant’s deposit until it is due to be repaid.
Any deposit received by Posh Pads will be registered with My Deposits within 30 days of receipt. https://www.mydeposits.co.uk/
The tenants will receive a copy of the DPS Prescribed Information within 30 days of paying their deposit.
10. Complaints Procedure and Redress Scheme We aim to provide the highest standards of service to all our customers, however if you do feel the need to make a complaint, please follow our complaints procedure which can be found on our website.
We are a member of the Property Redress Scheme, a government approved Redress Scheme which resolves complaints between Members and their consumers.
11. Reference Checks All proposed tenants and/or guarantors will be subject to reference checks prior to the tenancy being approved.
If we are unable to obtain suitable references, this may result in the cancellation of the property reservation or the requirement of 3 months paid advance rent.
12. Lead Tenant If you sign a joint group contract, you will be asked to nominate one of the proposed tenants to perform the duties of a Lead Tenant. They will be the first point of contact when Posh Pads needs to communicate anything regarding your tenancy. They will become the Lead Tenant and contact for My Deposits registration.
13. Data Protection Posh Pads complies with the Data Protection Act 2018 and the General Data Protection Regulations in relation to the use of personal data and data processing. You can find more details in our Privacy Notice which can be found at: https://www.poshpads.com/privacy-policy/
Tenant Declaration I confirm that I am over 18 years of age and the information given above is true and accurate. I understand that if any of the information in this application form is false or misleading, I will not be entitled to a refund of any Holding Deposit taken in relation to this application. I will notify Posh Pads without delay if any information becomes out of date or inaccurate.
I agree to Posh Pads making all the enquiries they deem necessary in connection with this tenancy application.
I consent to receiving my copy of ‘How to rent: a checklist for renting in England’, the energy performance certificate (EPC), gas safety certificate, electrical certificate, My Deposits custodial terms and conditions, My Deposits prescribed information and any other documentation relating to the proposed tenancy via the Arthur-Posh Pads App.
I understand that I must provide original documents proving the right to reside in the United Kingdom for the Arthur-Posh Pads App. I understand that if I do not provide these documents then I will not be granted a tenancy.
